Local Law 31 NYC’s New Lead Paint Inspection Law
New York City’s Local Law 31 of 2020 updated the lead paint inspection guidelines for building owners and landlords.

Local Law 31, according to NYC.gov, “effective August 9, 2020, Local Law 31 of 2020 states that an owner must use an Environment Protection Agency (EPA) certified inspector or risk assessor, independent of the owner or any firm to perform lead-based paint remediation, to test for the presence of lead-based paint in a dwelling unit of a building“.
New York City toughened its NYC Childhood Lead Poisoning Prevention Act. Here are some of the changes.
Building owners must perform certified lead-based paint inspections for ALL residential buildings before 1960.
Landlords are required to use X-Ray Fluorescence (XRF) by EPA-certified inspectors to test for lead in the paint.
Lead Paint Inspection Deadlines.
ALL NYC residential building owners must have their dwelling units inspected for lead paint by August 9, 2025.
If an apartment has a child under the age of 6, it must be inspected by August 2021.
Lead testing MUST BE COMPLETED within 1 year of the move-in date for an apartment if a family with a child under 6 moves in.
If a child spends time in a pre-1960 building for more than 10 hours a week, that unit must undergo the XRF testing EVEN though the child is not considered a fill time resident.
How To Properly Inspect A Unit For Lead Paint.
Local Law 31 requires that lead paint testing MUST BE performed by EPA-certified lead professionals and using XRF technology.
XRF is a machine that uses radioactive isotopes to detect for the presence of lead.
This test typically takes an hour and you’ll get a detailed report of all surfaces in the dwelling.
How To Pass Local Law 31.
To pass Local Law 31, simply have an inspection performed by an EPA-certified lead inspector or risk assessor.
The inspector must be independent of the owner or ANY FIRM hired to perform lead-based paint remediation.
As of December 1, 2021 the NEW THRESHOLD for defining lead-based paint was LOWERED from 1.0 mg/cm2 to 0.5 mg/cm2.
XRF lead inspections before December 1 can still use the OLD 1.0 mg/cm2 threshold. They will NOT need to be retested to be compliant with local Law 31.
